1. Introduction and Acceptance of Terms
These Terms of Service (the “Terms”) form a binding agreement between you and Rhymes Homes and Partners Limited (“Examyra,” “we,” “our,” or “us”), a company registered in the Federal Republic of Nigeria with registration number RC 941172, trading as Examyra, with its registered address at Wuse Zone 5, Abuja, Federal Capital Territory.
Examyra is an AI-powered examination preparation platform that helps Nigerian secondary school students prepare for JAMB, WAEC, NECO, and related academic examinations through AI-generated practice questions, topic mastery tracking, computer-based test simulation, personalised study recommendations, and progress reporting for parents and guardians.
By creating an account, accessing the platform, or using any part of our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not register for or use Examyra.
These Terms should be read together with our Privacy Policy and Refund Policy, both of which are incorporated into this agreement by reference and available at www.examyra.com.
2. Eligibility and Account Types
2.1 Who May Use Examyra
Examyra is intended for use by secondary school students preparing for JAMB, WAEC, and NECO examinations, and by the parents or guardians who support them. The platform offers two account types at registration: a student account and a parent account.
2.2 Minors and Parental Consent
Many users of Examyra are under the age of 18. Where a student registering for the platform is a minor, registration must be carried out with the knowledge and consent of a parent or legal guardian. Where a parent or guardian creates the account on behalf of a minor, that parent or guardian is treated as the responsible party for billing, communications, and compliance with these Terms.
We do not knowingly collect personal data from children under the age of 13 without appropriate parental consent, in line with the protections set out in our Privacy Policy.
2.3 Accuracy of Registration Information
You agree to provide accurate, current, and complete information when creating your account, including your full name, email address, school details, and examination targets, and to keep this information up to date. You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account.
3. Description of Services
Examyra provides the following core features, which may be expanded, modified, or adjusted from time to time:
- AI-generated practice questions across all 11 subjects: English, Maths, Physics, Chemistry, Biology, Economics, Accounting, Commerce, Geography, Government, and Literature
- Topic mastery tracking that identifies areas requiring further study
- Computer-based test (CBT) exam simulation with timed conditions modelled on the JAMB format
- AI-generated explanations for incorrect answers and personalised study plans
- A parent progress dashboard with weekly email reports covering subjects, scores, and study streaks
Practice questions presented on Examyra are generated using artificial intelligence and are intended to support exam preparation. While we take reasonable steps to ensure the relevance and accuracy of generated content, AI-generated questions and explanations may occasionally contain errors, and Examyra does not guarantee that any question will match the exact content, format, or difficulty of an official JAMB, WAEC, or NECO examination.
Examyra is not affiliated with, endorsed by, or operating on behalf of the Joint Admissions and Matriculation Board (JAMB), the West African Examinations Council (WAEC), or the National Examinations Council (NECO). References to these examination bodies are made solely to describe the scope of our preparatory content.
4. Subscription Plans, Fees, and Payment
4.1 Free and Paid Plans
Examyra offers a free plan, which includes all 11 subjects — English, Maths, Physics, Chemistry, Biology, Economics, Accounting, Commerce, Geography, Government, Literature — at no cost and with no payment details required, and paid subscription plans offered on the billing terms displayed on the Examyra website. Paid plans unlock the full Examyra experience across all 11 subjects, including unlimited practice sessions, CBT exam simulation, AI-generated explanations and study plans, the parent progress dashboard, and full topic mastery tracking.
4.2 Pricing
Current pricing for each plan is displayed on the Examyra website at the time of purchase and is stated in Nigerian Naira (NGN). We reserve the right to change our pricing structure for future billing periods, and any such change will be communicated to existing subscribers in advance of taking effect.
4.3 Payment Processing
Payments on Examyra are processed through Paystack, our approved payment gateway, which supports payment by card, bank transfer, and USSD. We may engage additional licensed payment processors from time to time. Card numbers and sensitive payment credentials are handled directly by the payment gateway and are not stored on Examyra's servers. By making a payment, you agree to the applicable terms of the payment gateway used for your transaction.
4.4 Subscription Activation and Renewal
Subscriptions are activated upon confirmation of successful payment and remain active for the billing period selected at checkout. Where a subscription is set to renew automatically, you will be notified by email in advance of the renewal date, in accordance with our Refund Policy.
5. Refunds and Cancellation
Refund eligibility, the refund request process, and applicable timelines are governed in full by our Refund Policy, available at www.examyra.com. You may cancel your subscription at any time through your account settings or by contacting legal@examyra.com, with cancellation taking effect at the end of the current subscription term.
6. Acceptable Use
When using Examyra, you agree that you will not:
- Share your account credentials with another person or allow another person to use your account
- Copy, scrape, reproduce, or redistribute practice questions, explanations, or other platform content for commercial purposes or public distribution
- Attempt to reverse engineer, decompile, or extract the underlying models or systems used to generate platform content
- Use automated tools, bots, or scripts to interact with the platform outside of normal use
- Upload or transmit any content that is unlawful, abusive, or infringes the rights of any third party
- Attempt to circumvent payment obligations, security measures, or access controls on the platform
- Use the platform in any way that disrupts its operation or the experience of other users
We reserve the right to suspend or terminate any account found to be in violation of this section, in accordance with Section 9 of these Terms.
7. Intellectual Property
All content made available through Examyra, including practice questions, explanations, study plans, branding, graphics, software, and underlying platform architecture, is the property of Rhymes Homes and Partners Limited or its licensors and is protected under applicable Nigerian and international intellectual property law. Examyra® is a registered trademark of Rhymes Homes and Partners Limited.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable licence to access and use Examyra for personal, non-commercial examination preparation purposes. No other rights are granted, and you may not copy, modify, distribute, sell, or lease any part of the platform or its content without our prior written consent.
Performance data, quiz results, and progress records associated with your account remain accessible to you for the purposes described in our Privacy Policy, but the underlying systems that generate and process this data remain our property.
8. AI-Generated Content and Educational Disclaimer
Examyra uses artificial intelligence, including models provided by Claude AI, to generate practice questions, explanations, and study recommendations. While these tools are designed to support effective exam preparation, they are not a substitute for classroom instruction, official examination syllabi, or guidance from qualified teachers.
We do not guarantee any particular examination outcome, score improvement, or admission result from the use of Examyra. Your results will depend on a range of factors beyond the platform's content, including your own study effort, prior academic preparation, and performance on the day of the actual examination.
9. Suspension and Termination
9.1 Termination by You
You may stop using Examyra and close your account at any time by contacting legal@examyra.com. Closure of your account does not, on its own, entitle you to a refund, which remains governed by the Refund Policy.
9.2 Suspension or Termination by Examyra
We may suspend or terminate your access to Examyra, with or without notice, where we reasonably believe that you have violated these Terms, engaged in fraudulent payment activity, misused the platform, or where required to do so by law. Where an account is suspended or terminated for a violation of these Terms, any associated subscription fees are non-refundable, as set out in our Refund Policy.
Upon termination, your right to access the platform ends immediately, though obligations relating to payment, intellectual property, and limitation of liability will continue to apply.
10. Limitation of Liability
Examyra is provided on an “as is” and “as available” basis. While we take reasonable steps to maintain the reliability and accuracy of the platform, we do not warrant that the service will be uninterrupted, error-free, or free of inaccuracies in AI-generated content.
To the fullest extent permitted under Nigerian law, Rhymes Homes and Partners Limited shall not be liable for any indirect, incidental, or consequential loss arising from your use of Examyra, including loss of study time, examination performance, or data, except where such liability cannot be excluded by law.
Nothing in these Terms limits our liability for fraud, willful misconduct, or any other liability that cannot be lawfully excluded or limited under the laws of the Federal Republic of Nigeria.
11. Privacy and Data Protection
Our collection, use, and protection of your personal information is described in our Privacy Policy, which forms part of these Terms. By using Examyra, you consent to the processing of your personal data in accordance with that Policy and applicable Nigerian data protection law, including the Nigeria Data Protection Act 2023.
12. Changes to These Terms
We may update these Terms from time to time to reflect changes in our services, applicable law, or industry practice. Where we make material changes, we will notify you by email or through a prominent notice on the platform at least 14 days before the changes take effect.
Your continued use of Examyra after the effective date of any revision constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, you should stop using the platform and may close your account.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Federal Republic of Nigeria, including the Federal Competition and Consumer Protection Act (FCCPA) 2019 and other applicable regulations. In the event of a dispute arising from these Terms or your use of Examyra, both parties agree to first seek resolution through our support process and, where necessary, mediation, before commencing formal legal proceedings.
The courts of the Federal Capital Territory, Abuja, shall have exclusive jurisdiction over any dispute that cannot be resolved through these means.
14. General Provisions
14.1 Entire Agreement
These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and Examyra regarding your use of the platform, superseding any prior agreements or understandings.
14.2 Severability
If any provision of these Terms is found to be unenforceable under applicable law, the remaining provisions will continue in full force and effect.
14.3 No Waiver
Our failure to enforce any right or provision of these Terms at a given time does not constitute a waiver of that right or provision.
14.4 Assignment
You may not assign or transfer your rights under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets, subject to the notice requirements described in our Privacy Policy.
